The Teaching of Criminal Law PDF
By:Kris Gledhill,Ben Livings
Published on 2016-08-19 by Taylor & Francis

The Teaching of Criminal Law provides the first considered discussion of the pedagogy that should inform the teaching of criminal law. It originates from a survey of criminal law courses in different parts of the English-speaking world which showed significant similarity across countries and over time. It also showed that many aspects of substantive law are neglected. This prompted the question of whether any real consideration had been given to criminal law course design. This book seeks to provide a critical mass of thought on how to secure an understanding of substantive criminal law, by examining the course content that best illustrates the thought process of a criminal lawyer, by presenting innovative approaches for securing active learning by students, and by demonstrating how criminal law can secure other worthwhile graduate attributes by introducing wider contexts. This edited collection brings together contributions from academic teachers of criminal law from Australia, New Zealand, the United Kingdom, and Ireland who have considered issues of course design and often implemented them. Together, they examine several innovative approaches to the teaching of criminal law that have been adopted in a number of law schools around the world, both in teaching methodology and substantive content. The authors offer numerous suggestions for the design of a criminal law course that will ensure students gain useful insights into criminal law and its role in society. This book helps fill the gap in research into criminal law pedagogy and demonstrates that there are alternative ways of delivering this core part of the law degree. As such, this book will be of key interest to researchers, academics and lecturers in the fields of criminal law, pedagogy and teaching methods.

Criminal Law and the Rights of the Child in Muslim States PDF
By:Nisrine Abiad,Farkhanda Zia Mansoor
Published on 2010 by BIICL

By analyzing legislative and judicial actions in a selection of Muslim and non-Muslim States in relation to the rights of the child in criminal matters, this book identifies the possible harmonization between the obligations of international human rights law (e.g. the UN Convention on the Rights of the Child [UNCRC]) and the criminal justice systems within each State, particularly Islamic law (Sharia). The book features introductory chapters on child offenders in criminal law and Islamic law, and country reports (from rapporteurs) on Afghanistan, Egypt, Lebanon, Iran, Malaysia, Nigeria, Pakistan, Spain, Turkey, the United Arab Emirates, as well as the UK. Among other issues, the book discusses: the definition of 'child' in criminal law * the rights for child offenders under international law (UNCRC, the Beijing Rules, etc.) * the rights of the child under Islamic regional instruments * Islamic law, as it relates to child offenders * the age of criminal liability * the death penalty * the role of the judiciary in criminal cases within Muslim jurisdictions. Theoretical and comparative research methods highlight that the position of Islamic law on the age of criminal liability and the legal rights of child offenders is nuanced, both through the way various ways Islamic criminal law is implemented and the role of the judiciary in expanding the protection of juvenile offenders.

Bare-Faced Messiah PDF

Published on 2016-01-07 by

Bare-Faced Messiah tells the extraordinary story of L. Ron Hubbard, a penniless science-fi ction writer who founded the Church of Scientology, became a millionaire prophet and convinced his adoring followers that he alone could save the world. According to his 'official' biography, Hubbard was an explorer, engineer, scientist, war hero and philosopher. But in the words of a Californian judge, he was schizophrenic, paranoid and a pathological liar. What is not in dispute is that Hubbard was one of the most bizarre characters of the twentieth century. Bare-Faced Messiah exposes the myths surrounding the fascinating and mysterious founder of the Church of Scientology - a man of hypnotic charm and limitless imagination - and provides the defi nitive account of how the notorious organisation was created.

International Handbook of Penology and Criminal Justice PDF
By:Shlomo Giora Shoham,Ori Beck,Martin Kett
Published on 2007-10-08 by CRC Press

At the outset of the twenty-first century, more than 9 million people are held in custody in over 200 countries around the world. --from the essay |Prisons and Jails| by Ron King The first comparative study of this increasingly integral social subject, International Handbook of Penology and Criminal Justice provides a comprehensive and balanced review of the philosophy and practicality of punishment. Drawn from the expertise of scholars and researchers from around the world, this book covers the theory, practice, history, and empirical evidence surrounding crime prevention, identification, retribution, and incarceration. It analyzes the efficacy of both traditional methods and thinking as well as novel concepts and approaches. Beginning with a study of the changing attitude of penal practice in Florida from one of offender transformation to one of risk-management, imprisonment, surveillance, and control, this volume embarks on an objective and sober appraisal of every aspect of the field. Contributions consider the sociology of incarcerated prisoners including the increasing prevalence of prison suicides. The book evaluates arguments regarding the world-wide abolition of capitol punishment from moral, utilitarian, and practical positions. It examines non-incarcerative and alternative punishments such as financial restoration and restrictions of liberty, as well as the positive effects of Victim Offender Mediation. It also considers several methods aimed at achieving measurable crime prevention including identifying at-risk juveniles and minimizing crimes of opportunity, as well as the pros and cons of employing the coercive power of police. Further essays consider subjects such as international policing, the roles of prosecution and defense attorneys, current discretionary sentencing practices, and the role and treatment of victims. The volume concludes with two chapters of case studies that provide a |hands-on| feel for the interplay of the concepts discussed. This volume is the first in a three-part trilogy. See also The International Handbook of Victimology and The International Handbook of Criminology.

Criminal Law PDF
By:Markus Dubber,Tatjana Hörnle
Published on 2014-03-27 by OUP Oxford

Criminal Law: A Comparative Approach presents a systematic and comprehensive analysis of the substantive criminal law of two major jurisdictions: the United States and Germany. Presupposing no familiarity with either U.S. or German criminal law, the book will provide criminal law scholars and students with a rich comparative understanding of criminal law's foundations and central doctrines. All foreign-language sources have been translated into English; cases and materials are accompanied by heavily cross-referenced introductions and notes that place them within the framework of each country's criminal law system and highlight issues ripe for comparative analysis. Divided into three parts, the book covers foundational issues - such as constitutional limits on the criminal law - before tackling the major features of the general part of the criminal law and a selection of offences in the special part. Throughout, readers are exposed to alternative approaches to familiar problems in criminal law, and as a result will have a chance to see a given country's criminal law doctrine, on specific issues and in general, from the critical distance of comparative analysis.

Criminal Circumstance PDF
By:Pamela Wilcox,Kenneth C. Land,Scott A. Hunt
Published on by Transaction Publishers

The main objective of this book is to propose an alternative criminal opportunity theory. The authors build upon social control and routine activities to develop a dynamic, multi-contextual criminal opportunity theory. Emphasizing the importance of contextual explanations of criminal acts, they propose two levels of analysis: individual and environmental. At each level, the theory pivots on three broad organizing constructs--offenders motivated to commit criminal acts, targets such as persons or property suitable as objects of criminal acts, and the presence or absence of individuals or other defensive mechanisms capable of serving as guardians against criminal acts. Crime is profoundly real, possessing qualities that make its occurrence and prevention pressing and persistent matters for individuals and societies. Theory, in contrast, is seen as highly abstract and removed from the seriousness of |real life.| Theory almost seems to be a peculiar sport of an academic class. The practically minded, even some academic criminologists, are often perplexed by the seeming obsession some scholars have with theory, which, after all, is nothing more than an explanation of facts. The practically minded, seeing a compelling need to identify the crucial factors that could be used to predict and prevent crime, wonder why anyone would invest precious time and energy into speculating about the abstract, underlying details of why crime occurs when and where it does. The authors contend that every intervention, prevention, and policy is based on some theoretical explanation of the causes of human behavior. The improvement of interventions, preventions, and policies is thus directly related to the improvement of theoretical understandings of the abstract, underlying details of the causes of crime. The development of explanations of events, when properly done, is a crucial component to understanding and possibly improving the |real world.| This work does just that.
